Last week I attended the Supima Design Competition held at the New York Times Center on January 19, 2010
Finalists: Gina DeSilva, Nadia Ivanova, Sachika Twins (To-Tam and To-Nya), Heber Sanchez, Robin Tomas and Michael Venker.
The winning t-shirt will be appearing in Bloomingdale’s along with the current Supima collection.
The giftbags also included some nice t-shirts too!
I recently switched from Blackberry to Iphone (jailbroken of course, more on that later) and something went wrong with the Cydia app I was using to capture pics/vids.

Ventured out to the Guggenheim Museum’s 50th anniversary yesterda
it was FREE! as opposed to the regular $18 ticket price, especially considering you CANNOT take any pics of the art!
Tips to all NYC museums-
1. Offer all your programs as downloadable PDF’s-I’m going to end up tossing it in the trash before I get on the subway no matter how slick it looks.
2. Offer a podcast of the audio tours-do you REALLY think I’m going to rent your little wack device for $7
Frank Lloyd Wright is a genius or a lunatic.
I went past the same exhibit twice from a completely different path.
I viewed the works of Kandinsky and eyed 2 Picasso’s.
Being there wanted me to see movie The International, the scene where they try to kill Clive Owen and destroy this place with gunfire!
I then went to the The Met with @thefatapple but it was closing and there is also NO picture taking there-I will go there for a longer visit when I load the app on my blackberry that shuts off the shutter sound
I saw this pic OUTSIDE the museum which was on sale for $10 with the frame-@thefatapple said this pic of President Obama as The Joker says so many things on so many levels.

When I first joined mytreo.net in February of 2005, I had no idea what I was getting myself into. I was late getting into the game, and at that time, MTDN was just a growing community. However, MTDN was quickly able to differentiate itself from any other forum [...] To the hardworking and dedicated community at mytreo.net, When I first joined mytreo.net in February of 2005, I had no idea what I was getting myself into. I was late getting into the game, and at that time, MTDN was just a growing community. However, MTDN was quickly able to differentiate itself from any other forum – it had a real sense of “community.” Not long after I joined, I was determined that if I was going to make a difference, it would here. That journey started in July of 2005, when I my application for a new downloads admin was accepted. This would become the start of a hobby, a rather addicting one! In the months that followed, I gradually learned the inner workings of MTDN, as well as HTML code, which I had no prior experience with. At that time, the Just Chat! section of General Chat was a popular escape from the technical talk of the rest of the forums, and there were several dedicated people who spent almost all of their time entertaining the rest of MTDN. At one point, I myself was also a Just Chat regular. At its peak, MTDN had over 4000 members online at a point. Soon, things changed. The MTDN store wasn’t viable financially, developers weren’t getting paid, and the admins were unofficially given “missing in action” titles. MTDN was in financial trouble, and a lot of us held our breaths as we waited for things to straighten out. Thankfully, it did, but we were pretty much left to fend for ourselves as MTDN no longer became a priority for the admins. Many team members slowly disappeared and the front page once went without an update for several months, but nonetheless, 500,000 members was achieved in September of 2008. The lack of a workforce behind MTDN resulted in my gradual increase in responsibilities, including front page writer, downloads admin, forum moderator, and of course, regular contributor. Knowing that single-handedly I would not be able to keep the site afloat, several regular contributors were introduced into the MTDN team, and a new chapter in MTDN history began. Daily activity increased significantly, and Just Chat briefly experienced a revival! Spammers arrived at MTDN in mid-2008. Running an older version of the SMF forum software, MTDN was vulnerable, and there was little that forum moderators could do. The moderators, as well as forum members, vigilantly looked out for suspicious posts, which were removed manually. I’m certain that many people knew in the back of their minds that the end of MTDN was close, but we refused to believe it. In early December, MTDN suddenly became inaccessible, and we were certain that the end has come. Checking MTDN dropped out of my morning routine, with the exception of an occasional attempt to access the forum, and my attention turned from phones to my newly purchased Maglite LED flashlights and CandlePowerForums. Having a couple members on my contact list, I was able to contact MiDoJo, who sadly confirmed the fact that MTDN was also down for him. We arranged to make an international call and contact head admin, Chris, and sure enough, our worst fears were confirmed. He was kind enough to put the site back online for us to say a quick goodbye. So if I haven’t said it already, thank you for all the good memories, and it is unfortunately time for us to say good-bye. But now that the cat has been let out of the bag -- or closet, as the case may be -- by the mainstream media, let's... go there. From the San Francisco Chronicle: The biggest open secret in the landmark trial over same-sex marriage being heard in San Francisco is that the federal judge who will decide the case, Chief U.S. District Judge Vaughn Walker, is himself gay. Shocking? Not exactly. Judge Walker is a professionally successful white male, with great job security and a six-figure income, who's in his sixties -- and has never been married. A confirmed bachelor, if you will. Who lives in San Francisco. Umm, yeah. (On the other hand, we hear His Honor's favorite drink is a Maker's Mark Manhattan -- a fairly butch beverage, despite the maraschino cherry. We'll stick with our cosmos, thank you very much.) So this brings us to the question that Ashby Jones posed over at the WSJ Law Blog earlier today: If Judge Walker is gay, what should we make of that fact? The Chronicle tried to get underneath his robe, to find out what Judge Walker bangs his gavel to. But His Honor did not cooperate: Walker has declined to talk about anything involving the Prop. 8 case outside court, and he wouldn't comment to us when we asked about his orientation and whether it was relevant to the lawsuit. Alanis Morissette concurs. And that sure sounds like an admission by Judge Walker that he's a friend of Dorothy, doesn't it? He's not exactly denying it. When the Chronicle asked him if he had "any concerns about being characterized as gay," the judge answered with "no comment." We reached out to law professor Arthur Leonard, an expert on the federal courts and LGBT rights, for some insight into the situation. Professor Leonard seemed to view Judge Walker's potential proclivities as a non-issue. "[E]verybody whose opinion was canvassed by the Chronicle agreed that Judge Walker's sexual orientation was essentially irrelevant to his being the judge on this case," said Professor Leonard. "He's respected as a very professional, impartial judge." Very true. We've heard nothing about Judge Walker as a jurist that would call into question his impartiality in this case. We've also heard many positive comments about his intellect -- note his probing, smart questions during the Prop 8 trial -- and his work ethic. For example, Judge Walker often works on the weekends (unlike many other federal judges, who take advantage of life tenure to slack off a bit). In other words, just because Judge Walker "[T]here is a tendency to think that only members of minorities are 'biased' about cases involving their issues," said Professor Leonard. "It's the majority-centric way of seeing things, that assumes that straight white males are, of course, neutral, while everybody else has a point of view. But everybody has a point of view on most issues, and the job for the judge is to separate out his or her personal views from his or her professional role and to strive to take an 'objective' approach to deciding the legal issues in the case." An ATL commenter on Morning Docket, where we previously linked to the Chronicle article, made a similar point: "I would have just as much of an issue if a heterosexual judge were hearing the Proposition 8 trial... and that is to say, none at all." But there is certainly room for disagreement here. Some other possible perspectives:
(That last point may be something of an overstatement. Even if the case ends up being resolved by a higher court, it will be resolved based on a trial record that was crafted by Judge Walker.) I know I get accused of being all of the above all the time. The other day in New York I gave a speech at the AlwaysOn Conference which AdWeek summarized nicely here. The audience was primarily newspapers and people related to their business. So as I do when I speak to a group like this, rather than just shilling a product, service or position as many, if not most keynote speakers do, I try to put myself in the business shoes of the audience. Then I discuss what I would do if I owned, ran or invested in their business, and the approach I would take to some of the strategic issues of the day. The concept of directing comments to a vertical segment of a market is nothing new. I have been doing it for more than 20 years. Yet for some reason, based on comments from a few folks over the past couple days, there are some relatively high profile people in the internet business that have a tough time grasping that concept. Tech Crunch - a site I love. SearchEngineLand – Run by Danny Sullivan, I think he Danny likes to banter to create traffic, smart on his part. But I also think he doesn’t fully understand all the business elements on some of the topics he has challenged me on. Then there is Jeff Jarvis who always like to slam me. Which is ok by me. I just consider the source. As Jeff describes himself ”Most of my holdings today are in mutual funds because I’m a lousy investor.” Which tells me all I need to know about his business knowledge. While its fun to make a list of those who have criticized me, the criticism is incredibly valuable. As a businessperson and one who tries to stay ahead of the technology and business curve, even when it means taking a position that is far from popular, critics serve the purpose of always “making you check your hole card” . In other words, the more a position I take gets challenged, the smarter I get on the position. So the criticism is welcome. Of course the criticism can be fun for me to challenge and also wrong. Which much of the criticism of my Newspaper Industry speech is. Danny Sullivan thought he had caught in some hypocritical act because I am an investor in Mahalo, a human powered search engine that leverages SEO techniques to increase traffic and revenue. First of all, I invested in Mahalo in 2006 . Not yesterday as Danny would seem to imply. Nor am I involved in the day to day management of the company. Im always available to answer questions when they ask. Which they do every so often. Second, EVERY presentation or discussion of actions I thought the newspaper industry should take ALWAYS had the qualifier that the newspaper had significant amounts of unsold inventory. My point being that if the traffic Google was sending you was not being monetized and you didn’t see a way to monetize the traffic, it was time to make a business decision reconsidering the value equation of traffic coming from Google or Google News vs the strategic implications of staying in their index and offerings. Topics I discussed in my last blog post. I also discussed in a prior blog post, but unfortunately didnt have time to cover in my 12 minute keynote at Always On, that twitter and facebook were becoming significant sources of traffic to newspaper sites. A fact that should be considered in the value equation and which in the long run could become a threat to Google’s Search and News . (a point Im sure Google has also taken note of ) We increasingly look to friends and/or our social networks as a trusted source for information, and because that information is broadcast to us rather than us having to go find it, and because Twitter and Facebook updates are not going to be competitive threats to the newspaper business, leaving Google is no longer unimaginable for Newspapers. In the case of Mahalo, unlike newspapers, they are making good money from Google traffic. No reason to stop doing that. On the flipside however, its fair to point out that Mahalo does use some newspapers content to support their content. If a newspaper would ask me if they should block Mahalo, the fair answer would be that there is no reason not to. Like Google, the traffic from Mahalo would not justify the value Mahalo gets from their content. If the CEO of Mahalo were to ask me how Mahalo should deal with newspapers, I would tell him he should work out a licensing deal with the newspapers. That it would be found money for newspapers, so he could most likely get some level of exclusivity on their content in exchange for a minimal amount of money that would be in the form of an advertising revenue share from pages that host their content. It would be a simple revenue arbitrage for him while also giving him a nice differentiator that would allow him to promote being an exclusive source of content from companies he worked out deals with. Moving on to TechCrunch, Michael Arrington asks the question of why I could be so enthusiastic about Techmeme, a site that I use regularly and to which I point to from my blogroll. I think his point is that its an aggregator and as such, shouldn’t I be cautioning newspapers about Techmeme and warning them to opt out of it ? In response I will refer back to my references about monetizing and leveraging Google traffic. My rule for ANY site receiving traffic from an aggregator of ANY kind is: If you believe you can create more value from the traffic you receive than potential negative branding implications plus the cost of supporting a potential competitor, then continue with the aggregator. If not, block the aggregator. In the case of techmeme, I dont see it ever originating content from the site. So I would strike the competitive aspect of it. Nor does Techmeme attempt to index the entire internet looking for sources. Instead, if i understand it correctly, Gabe Rivera, the guru behind techmeme personally cultivates the sources he includes in the techmeme index. Because this is purely a tech driven site, and given that participating sites must be “selected”, I would argue that there actually is brand enhancement to being identified as a source on techmeme. That said, in the event you think that techmeme is gaining more value from your site, than your site is from techmeme, Gabe offers a “leaderboard” where you can check to see just how important you are to the site. I am sure that Gabe would be happy to exclude you from the site if that is your conclusion. The same applies to one of my other investments, icerocket.com . Icerocket was formed in 2004 to be a real-time search engine. I wanted to be able to search blogs for information that I thought was important and also have those search results continuously available to me through RSS feeds. It was and is the most expedient manner to keep up with what the blogosphere is saying about a topic. Icerocket’s strength has always been its ability to exclude spam. To this day it does a better job than Google or any other search engine that includes blogs at finding and giving you real results. When twitter hit the seen, it was a natural to include twitter results as well. IMHO, and in the opinion of others, Icerocket is as good or better than any other real time search engine out there. Should your site stay in the Icerocket index ? That is up to you. If you would like to see your blog posts or tweets gain more visibility, then Icerocket will help you. We aren’t the biggest, but our real-time search is growing very, very quickly. Which gets me to the necessary conclusion. The reality of today’s business world is that there are no absolutes. If I invest in a search index or aggregator, that doesn’t mean I believe every website in the world should be in the index. It means I believe that the business can offer enough value to those it has a relationship with to make that relationship win-win. Nor does it mean that a company is “evil” or that I don’t like it. Its real world that you will compete with companies that you do business with. Superfeedr.com is a business I have invested in for realtime push of information that works with information aggregators and content creators of all types that compete with other businesses I own. So does SMASH , which does cookies for Text Messaging. So what. Every business has its own decision making critical path that must be re-evaluated daily. For some reason, many of the internet persuasion seem to think that 2010 is the same as 2009, which is the same as 2008, etc, etc. Its not. Things change. Every business must re-examine the variables that impact their current and future profitability. Your relationships with Google, Mahalo, Icerocket, in 2010 may need to be different than they were in 2006. This seems like an obvious conclusion to me, but it apparently isn’t to some. ![]() |

And perhaps my hair is a little less alarming. But here I am, on the brink of thirty! In honor of the last year of my twenties, I threw myself a birthday party at one of my favorite college drinking haunts in the Village. It’s exactly the same as it was when I spent most Thursday nights there, only now they serve a pretty good dark & stormy and there aren’t any ashtrays. It was extremely strange but entirely entertaining having so many of my friends in one place, particularly friends from such wildly different contexts. Coworkers, ex-coworkers, gaming friends, college friends, and people I’ve known for so long I don’t even remember how I know them. I had a really splendid time and poured myself into a cab at the end of it all with such an abundance of flowers and presents and affection and alcohol that I felt quite fancy. So, I would say that 2010 is off to a pretty good start. |

Considering I’ve smoked over a box of the Carlos Torano Exodus 1959 50 Years Short Churchills it was time to write the review. I meant to write it about a month ago, but the holidays and the kids bringing home colds to share forced me to cut back on how much I’ve been smoking. The Exodus 1959 50 Years commemorates the 50th Anniversary of the Torano Family’s exodus from Cuba and is the third cigar to join the Exodus line. It is available in three sizes Robusto (5 X 50), Torpedo (5 1/2 X 52) and Short Churchill (6 X 48). The Wrapper is Brazilian Arapiraca Sun-Grown, the Binder is Honduran and the Filler is a blend of Nicaraguan tobacco from Esteli and Pueblo Nuevo. Already a fan of Brazilian tobacco and the Exodus line it didn’t take much for me to fall in love with this full bodied, full flavored cigar. I’ve smoked all three sizes and haven’t had any issues with the construction. I’m impressed when I can go through 30+ cigars of the same blend and not have any issues. The cigar has a spicy bite that is mellowed some by the sweet dark chocolate flavor and the finish had a leather quality to it. Occasionally I picked up something that reminded me a bit of coffee with cream and sugar. Verdict: For the past couple of months this has been my go to cigar. This is my favorite cigar of 2009. A fantastic full flavored cigar that is reasonably priced at under $7.00 in my local shop. If you find them don’t get one or two, get a box. After the 2004 breach of Cisco, the proprietary source code for Cisco’s IOS operating system was discovered on a Russian website. Pettersson was indicted in the United States in May on five hacking counts, (.pdf) but could not be brought from Sweden to the United States for trial. Sweden does not extradite its own citizens, but said it was examining whether to prosecute him in Sweden after U.S. authorities in San Francisco initiated that request. “The intrusions to Cisco Company and NASA are regarded as computer intrusion according to Swedish law,” (.pdf) Swedish prosecutor Chatrine Rudstrom told federal prosecutors in San Francisco, according to documents released Monday. Still, Rudstrom told San Francisco federal authorities that Sweden was not guaranteeing it would charge the 21-year-old suspect. A federal court policy-making body is belatedly entering the internet age by proposing that judges clearly inform jurors they must not electronically discuss cases they are hearing. It’s standard procedure to inform jurors to remain mum and not conduct any research about the case until a verdict. But recent gadget use by jurors has forced the hand of the Judicial Conference of the United States, the policy-making body of the federal courts. The model jury instructions (.pdf) the Judicial Conference released to the federal judiciary in late January specify:
U.S. District Judge Julie Robinson of Kansas, the chair of the Judicial Conference Committee on Court Administration and Case Management, told the nation’s judges in a Jan. 28 memo that the new jury instructions “address the increasing incidence of juror use, of such devices as cellular telephones or computers, to conduct research on the internet or communicate with others about cases.” Robinson told fellow judges that “more explicit mention in jury instructions of the various methods and modes of electronic communication and research would help jurors better understand and adhere to the scope of the prohibition against the use of these devices.” A federal drug trial in Florida ended in a mistrial last year when eight jurors admitted they were doing internet research on the case they were hearing. Among other examples, there was a call — although unheeded — for a mistrial when a juror was discovered tweeting and publishing trial updates on Facebook in the prosecution of Vincent Fumo, a former Pennsylvania state senator convicted of graft. There are no nationwide instructions for the state courts, because each state adopts its own set of jury instructions. I was a Super Nintendo kid growing up. But even the biggest Nintendo nerds couldn’t fake on Sonic. Mario games had more content, secrets and are arguably better in terms of replay value. But Sonic 1-3 were dope for their break neck speed, new moves and edgy flavor that truly showed they were a product of the 90’s. The first batch of sidekicks were great too as anything created after Knuckles can kick rocks. Then the Sonic name fell off with one mediocre release after the other. You’d think that the franchise should’ve retired as its popularity waned over the years. But Sega decided to actually try to revive the glory days of everyone’s favorite Blue Hedgehog with Sonic 4 Episode 1. Like NBA Jam, the game (and trailer) obviously feeds on nostalgia as it’ll strictly be a 2D affair like the trilogy it’s based on. I’m happy the game is returning to its roots because that’s when the franchise was at its best. That also means Sonic will be the only playable character going by Joystiq’s word. The trailer suggests that this will be a downloadable game from Xbox Live, PSN or Wii Ware. With that out of the way I’m somewhat skeptical about this “episode” malarkey they’re trying to pull. We haven’t seen any official word on how many levels are in an episode or how much each will cost. Let’s just hope consumers won’t have to break out the wallet too tough for the full experience. Anyway the blue bomber will be back in business this summer. Here’s hoping Sega knows what they’re doing with this one. |

They’re back at it again. The iPhone dev-team has released an update to their popular jailbreaking software, PwnageTool, for Mac OS X. The new PwnageTool — version 3.1.5 — boasts the ability to properly jailbreak Apple’s recently released 3.1.3 iPhone/iPod Touch firmware. Before you get too excited, the dev-team does offer up this proclamation, “Unless you’ve personally observed a problem with the reporting of your battery percentage, there’s no reason to update to 3.1.3.” For those that feel the need for a jailbroken iPhone or iPod Touch with the 3.1.3 firmware follow the read link; let us know how it goes in the comments. |

Motorola has been going toe and toe with RIM over alleged patent infringement both here in the US and across the pond in the UK. Motorola’s UK case focused on BIS and BES technologies, claiming that the two messaging systems infringe upon patents that Motorola holds for an RF-based message communication system. In ruling against Motorola, the judge noted that messages from BES servers were not suitable for RF transmission and that RIM’s BIS servers are physically located in Canada and are out of the court’s jurisdiction. In a further blow to Motorola, the court held that there was no inventive step and the patent itself was declared invalid. Sorry Motorola, better luck next time, we guess. |
